4. John Jarvis (3rd)

John Jarvis (3rd) was baptised at All Saints Church, Birchington on 23rd September 1694, the eldest child and only son of Daniel and Mary Jarvis.  He had three sisters, Anna, Elizabeth and Jane, two of whom died young.

I believe he married Anne Kirby at Monkton on 5th January 1715.  On the marriage entry his name is listed as Jno Jervaise. 

Until 1871 Birchington was part of the ecclesiastical parish of Monkton, and the vicar of Monkton was also vicar of Birchington and St. Nicholas at Wade.  He had to supply a curate or minister to serve these churches.  Between the years 1662 and 1729 Birchington was without a curate and there were very few marriages in the parish, most couples having to go to Monkton for their nuptials.

John worked originally in Birchington as a carpenter.  He and Anne had eight children.  Mary 1716,  Daniel 1720,  Anna 1722,  Anne 1724,  Elizabeth 1727,  Jane 1729,    John 1731  and  Priscilla 1733.

John and Anne moved to Margate (date unknown) where he worked as a Tidesman.  Tidesmen controlled the loading and unloading of cargoes and worked very closely with the customs officials, known at that time as riding officers.

John died on the 26th October 1765, aged 71 years.  He was buried at Birchington on the 31st October.

It was about this date that Johns widow, Anne, and sons Daniel and John rebuilt Laburnum House in Birchington in the ‘low countries’ style with Dutch gable ends.  The earliest photograph of Station Road, dated about 1880, shows the house.  The small cottage next door was built slightly later and was demolished in about 1895 and replaced by two late Victorian shops.

The house was built on part of a three rod plot, which was the garden of the older property mentioned in an original deed of 1619.  The tithe map of 1839 lists the house, when it had probably changed its name to Mulberry House.  The original ordnance survey map of 1872 shows both houses with a tree, possibly a mulberry or a laburnum, in the road outside.  This tree still stood there in the early 1900s and had a seat round it on which locals used to sit on warm summer evenings.

At one time five separate plots of land belonged to the property.  This included a one and a half acre site called ‘The Butts’.  This was a piece of land which though privately owned was originally used by the villagers for practising their archery skills.  It was situated at the bottom end of what is now Station Road, more or less opposite dog acre.  The Jarvis family sold the plot, along with others, and eventually in 1899 it was sold as building land.

Anne Jarvis died on the 12th January 1767, and was buried in Birchington churchyard on the 17th January.

The Stranacks were a seafaring family who arrived in Margate in the late 17c, and stayed in the area for the next 250 years.  Priscilla and John originally lived near Fort Green, Margate, but owned other property in the town as well.  They had nine children, four of whom died in infancy.

John Stranack died in 1799, and Priscilla on the 15th March 1804.  They were both buried at Birchington with the rest of the Jarvis family.

The Will of John Jarvis (3rd)

I John Jarvis of Margate in the Isle of Thanet, in the county of Kent, Tidesman, being in tolerable health, but of sound and perfect mind, memory and understanding, considering the …. of this life, being desirous to settle that estate wherewith it has pleased God to bless me.  I do make and ordain this my last will and testament in writing in manner and form following.

That is first I do give and devise as much as in me lies unto my wife Ann Jarvis during her life.  She keeping the same in good and tenantable repair.  All that my messuage or tenement with the barn, stable yard and land to the same belonging and appertaining containing by estimate four acres more or less, with the appurtenances containing by estimate four acres more or less with the appurtenances. Lying and being in the Parish of Birchington, in the said Isle and County, and now or late in the tenure or occupation of John Coleman.

And from and after the demise of my said wife Ann, I do also as much as in me lies, devise the same premises unto my sons Daniel Jarvis and John Jarvis to hold the same unto my said two sons Daniel and John Jarvis as tenants in common, and not as joint tenants.  And to their respective heirs and assigns.  And it is my desire, mind and will that my said sons do permit and suffer my said wife reasonably to posses and enjoy the said mentioned premises during her life, without any molestation or denial from them or either of them.

And as to all the rest and residue of my messuage, lands, tenements, hereditaments and real estate whatsoever and wheresoever, and not here by me before devised, whether in possessions, reversions or remainder, I do give and devise the same and every part thereof unto my said wife Ann Jarvis.  To hold to her, my said wife, for and during the term of her natural life.  She keeping the same in good and reasonable repair and making no spoil, waste or distraction there upon.

And from and after the demise of my said wife Ann, I do give and devise the same last mentioned premises and every part thereof unto my six daughters, namely Mary wife of Thomas Wood, Anna wife of Thomas Holness, Anne Reynolds, Elizabeth wife of John Seath and Jane wife of Thomas Cramp and Pricilla wife of John Stanack.  To hold the said unto my six daughters, Mary Wood, Anna Holness, Anne Reynolds, Elizabeth Seath, Jane Cramp and Pricilla Stanack as tenants in common and not as joint tenants.  And to their respective heirs and assigns.

Also I do give unto my said wife Ann after my just debts and funeral expenses are paid and discharged for and during the time and form of her natural life …. use and enjoyment of all and singular my ready money and monies due and owing upon securities, and otherwise.  And all … devise my goods, chattels, gold rings, plate linen, wearing apparel, bedding, household stuff, furniture, mortgages, securities, monies in the public stocks or funds or personal estate whatsoever, and wheresoever, and of what kind, nature, value or quality so ever, the same shall exist and be at the time of my decease.

And from and after the demise of my said wife Ann I so give the said household goods, chattels, mortgages, securities, monies in the public stocks or funds and personal estate unto my said six daughters, Mary Wood, Anna Holness, Anne Reynolds, Elizabeth Seath, Jane Cramp and Priscilla Stanack, equally to be divided between them, share and share alike, and to their respective executors, advisors and assigns.

And I do direct and appoint that my said daughter Anna Holness shall out of her part of the real and personal estate by me before given to her, pay, discharge the bond and mortgage severely thereon lately purchased unto and given from her husband (my son-in-law Thomas Holness, to my son-in-law Henry Bourne deceased, for the sum of forty pounds and interest.  If the same should happen to be paid off and discharged at the time of the decease of the survivor of me the said John Jarvis and Ann my wife. And I do hereby charge the same with the true and just payment thereof.  And I do also authorise, direct and appoint my said sons, Daniel Jarvis and John Jarvis, two of my executors hereafter named, after my decease and of my said wife Ann to pay and discharge out of the part of the personal estate by me herein given to my said daughter Anna Holness the said bond and mortgage severely or such part thereof as they shall see fit.

And I do further direct and appoint that my said daughter Jane Cramp shall out of her part of the real and personal estate by me before given her, pay and discharge the bond lately entered into and given from her husband, my son-in-law Thomas Cramp, and myself to Sarah Thompson of the parish of St. Lawrence, in the said Isle and county, widow, for the sum of fifty pounds and interest.  Being the proper debt of the said Thomas Cramp, if the same should not happen to be paid off and discharged at the time of the decease of the survivor of me the said John Jarvis and Ann my wife.

I do hereby charge the same with the true and just payment thereof.  And I do also authorise, direct and appoint my said executors after the decease of my said wife, to pay and discharge out of the personal estate by me herein given to my said daughter Jane Cramp, the said bond or such part thereof as they shall see fit.

And I do make, constitute and appoint my said wife Ann Jarvis and my said sons Daniel Jarvis and John Jarvis, joint executors of this my last will and testament.  Hereby revoking and making void all former and other wills and testaments by me at any time or times heretofore made and given.

And do publish and declare and confirm this present writing contained in these sheets of paper to be and containing my last will and testament, and none other nor otherwise in writing where I the said John Jarvis first above named hereto this my last will contained in these sheets of paper, set and put my hand and seal to each sheet affixed together, this thirteenth day of April in the year of our Lord one thousand seven hundred and sixty two.  And in the second year of the reign of our sovereign Lord, George the third, by the grace of God, of Great Britain, France and Ireland.  King, defender of the faith, and so forth.

John Jarvis signed, sealed, published and declared by the said John Jarvis first above named the testator for and as his last will and testament, in the presence of us who have hereunto subscribed our names as witnesses. John Sandwell, Francis Biggs, Thomas Huffam.

On the fourteenth day of February in the year of our Lord, one thousand seven hundred and sixty six, appeared personally Daniel Jarvis of the town and borough of Deal in the county of Kent, gentleman, and John Jarvis of the same place, gentleman.  Who being sworn on the Holy Evangelists? to depose the truth, did jointly and severerally say and depose the followeth.  That is to say that they are the two only sons of John Jarvis late of Margate in the Isle of Thanet in the county of Kent deceased, and two of the executors named in his last will and testament.  And that the said John Jarvis the testator died on or about the twenty sixth day of October last past.  And the said deponent John Jarvis for himself further saith that soon after his said fathers demise he went to Margate, aforesaid, to the house of John Stanack of Margate, aforesaid, mariner, his brother-in-law, where he had been informed the said last will and testament of his said father John Jarvis was deposited.  And asking for the said will he received the same of his sister Priscilla, the wife of the said John Stanack, and brought the same home to Deal aforesaid, and delivered the same to his brother the said deponent Daniel Jarvis at Deal aforesaid.  And that the will hereunto annexed is the same will, which he received of his said sister Priscilla Stanack.

And the said Daniel Jarvis for himself saith that the will and testament annexed is the same will which was brought unto him by his said brother John Jarvis.  And the deponents jointly and severally further depose that when they first saw the said will of the said John Jarvis hereunto annexed beginning thus – In the name of God, Amen.  I John Jarvis of Margate in the Isle of Thanet in the County of Kent – and ending thus – In witness whereof at the said John Jarvis first above named have to this my last will contained in these sheets of paper, set and put my hand and seal, each sheet affixed together, this thirteenth day of April in the year of our Lord one thousand seven hundred and sixty two, and in the second year of the reign of our sovereign Lord, George the Third, by the grace of God, of Great Britain, France and Ireland.  King, defender of the faith and so on.  And thus subscribed John Jarvis.

They respectively observed the obliteration of the words Bourne’s widow in the twenty- fourth line of the first sheet of the said will, computing from the top thereof, and the word Reynolds superlined? over the same.  Also the word Bourne obliterated in the twenty- sixth line of the first sheet of the said will, computing from the top thereof, and the Reynolds superlined over the same.  Also the word Bourne obliterated on the sixth line of the second sheet of the said will and the word Reynolds superlined over the same.

And do jointly and severally say and depose that the said will is now in all respects in the same …. and condition as when it was first received by them, without any alterations or additions whatsoever.  And further depose that Ann Bourne so mentioned in the said will whose name appears obliterated as before deposed, and that Ann Reynolds whose name appears ……… as aforesaid, is one and the same person, and not diverse.  And say that she the said Ann Bourne later married with John Reynolds, her present husband, on or about the fourth day of August in the year of one thousand seven hundred and sixty one, since the making of the said will.

Daniel Jarvis, John Jarvis.  The same day the said Daniel Jarvis and John Jarvis now truly swear to the truth of this affidavit before me a …..

This will was proved at London the twenty second day of February in the year of our Lord one thousand seven hundred and sixty six, before the Right Worshipful …………… of Law, Master keeper of commissary of the prerogative court of Canterbury, lawfully constituted by the oaths of Anne Jarvis, widow, the relict of the deceased John Jarvis.  And John Jarvis the son of the said deceased, and executor named in the said will, to whom administration was granted of all and …… the goods, chattels and credits of the said deceased.  He having been first sworn by commission duly to administer.

 

After the death of John and Anne in October 1765 and January 1767 their children sold the property in Birchington.  The daughters were all married, and the two sons Daniel and John (4th) had joined the Royal Navy and were living at Deal.

By Indenture of Lease and Release made between Daniel Jarvis of the Town and Borough of Deal in the County of Kent, Gent, and Sarah his wife, John Jarvis of Deal aforesaid, Gent, and Anne his wife, (which said Daniel Jarvis and John Jarvis are therein described as the two only sons and co-heirs in gavelkind of John Jarvis then late of Margate in the Isle of Thanet in the said County, Tidesman, but formerly of the Parish of Birchington in the said Isle and County, carpenter, their then late father deceased.)  Thomas Wood of the City of London, Cordwainer, and Mary his wife, Thomas Holness of the Parish of Birchington aforesaid, Husbandman, and Ann his wife, John Reynolds of the Parish of Sturry in the said County, Collar maker, and Ann his wife (formerly named Ann Bourne Mrs.), John Seath of the City of Canterbury, Cabinet Maker, and Elizabeth his wife, William Wildbore of Deal aforesaid, Haymaker and Jane his wife (formerly named Jane Cramp Mrs) and John Stanack of Margate aforesaid, Mariner, and Priscilla his wife, (which said Mary Wood, Ann Holness, Ann Reynolds, Elizabeth Seath, Jane Widbore and Priscilla Stanach are there described as the six only daughters and also devisees for fee named in the last will and testament of the said John Jarvis deceased their then late father) of the one part and Richard Lawrence Bowles of the said Parish of Birchington, Gent (a Riding Officer in His Majesty’s Customs) of the other part.

It is in and by Indenture now abstracted Witnessed that for and in consideration of the sum of £267 to them said Daniel Jarvis and Sarah his wife, John Jarvis and Ann his wife, Thomas Wood and Mary his wife, Thomas Holness and Ann his wife, John Reynolds and Ann his wife, John Seath and Elizabeth his wife, William Wildbore and Jane his wife, and John Stanach and Priscilla his wife, Did and each and every of them Did Grant, Bargain, Sell, alien rel: ratify and confirm unto said Richard Lawrence Bowles (in his actual possession etc.) and to the heirs and assigns of the said Richard Lawrence Bowles.

All that new built messuage and tenement with the barn, stable and garden thereto belonging, with the appurtenances situated, lying and being in the Parish of Birchington aforesaid in the said Isle of Thanet and County of Kent, and then late in the tenancy or occupation of the said Richard Lawrence Bowles and his assigns.  And also all that other messuage or tenement (into two tenements divided) with the yard and garden thereto belonging with the appurtenances situated lying and being in the Parish of Birchington aforesaid, in the said Isle of Thanet and County of Kent and then late in the … or occupation of Michael Hughes and Ann Jarvis…….deceased or one of them, their or one of their indents or assigns and one of them then or their lately was in the occupation of the said Michael Hughes or of his aforesaid, and the other was untenanted. 

And also all those five several pieces or parcels of land containing together by estimate 3 acres 13 rods more or less, lying and being in the Parish of Birchington aforesaid, in the Isle of Thanet and County of Kent, with their appurtenances, and then or late in the tenancy or occupation of the said Richard Lawrence Bowles or his assigns, one of which said several pieces or parcels of land containing by estimate 3 roods (more or less) abutted the Kings highway there towards the north, to the lands formerly of Henry Spratling towards the east, to the Church Yard of Birchington, aforesaid, and the lands formerly of Thomas Crispe Esq. towards the south, and to the lands formerly of the said Thomas Crispe towards the west.

One other piece thereof containing by estimate one acre and a half (more or less) lying at or near a place now called the Butts abutted to the Kings highway leading from Birchington Church to Gore End to the south west, to the Church lands towards the north west, to lands formerly of John Laming towards the north east, and to lands formerly of John Hayward towards the south east.

One other piece thereof containing by estimate half an acre and lying towards the sea abutted to lands formerly of Thomas Kirbie towards the east and south, to lands formerly of John Laming towards the west, and to lands formerly of Robert Sayer towards the north.

One other piece thereof containing by estimate three roods (more or less) abutted to lands formerly of the heirs of Sir Henry Crispe, Knight, towards the north and west, and to lands formerly of the said Thomas Kerbie towards the south and east,

And the remaining piece or parcel thereof containing by estimate one rood and ten perches (more or less) abutted to lands formerly of the heir of Sir H.J. Crispe, Knight, towards the north and east, to lands formerly of the said John Laming towards the south, and to lands formerly of the said Thomas Kerbie towards the west or howsoever otherwise. The said several pieces pr parcels of land did abut, lye or bound or were called, described or known.  And all Ways etc. and the reversion etc. and all the estate etc.

To hold unto the said Richard Lawrence Bowles and his heirs and assigns to the only proper use and behoof of said Richard Lawrence Bowles, his heirs and assigns forever.

Usual covenants with a covenant to buy a fine by the said parties of the same premises the uses whereof were declared to be…..

To the proper use and behoof of said Richard Lawrence Bowles, his heirs and assigns forever, and to and for no other intent or purpose whatsoever.

Executed by all parties except the said Richard Lawrence Bowles and attested and received for consideration money indorsed.

By indenture made between said Daniel Jarvis and Sarah his wife, John Jarvis and Ann his wife, Thomas Wood and Mary his wife, Thomas Holness and Anna his wife, John Reynolds and Ann his wife, (formerly named Ann Bourne Mrs.) John Seath and Elizabeth his wife, William Wildbore and Jane his wife (formerly named Jane Crump Mrs) and John Stanack and Priscilla his wife, of the one part and the said Richard Lawrence Bowles of the other part.  After reciting that they the said Daniel Jarvis and Sarah his wife, John Jarvis (party thereto) and Ann his wife, Thomas Wood and Mary his wife, Thomas Holness and Anna his wife, John Reynolds and Ann his wife, John Seath and Elizabeth his wife, William Wildbore and Jane his wife and John Stanack and Priscilla his wife, did by indenture of Lease and rel: (hereinbefore abstracted) and Rel: bearing the date the date next before the day of the date of the now abstracting Indenture granted and conveyed unto said Richard Lawrence Bowles his heirs and assigns for said premises.

Then it is in and by Indenture now abstracted that for barring and destroying of all Estates Tail and all Reversions and Remunerations thereon expectant and all jointures dowers right and title of dower of, in, and upon said several messuages, lands, tenements, hereditments and premises and for settling and assuring the same to and for the uses, intents and purposes thereinafter mentioned, limited, and declared of and concerning the same and for corroborating and confirming to said Richard Lawrence Bowles for the estate to him therein above mentioned to be granted and conveyed of and in said messuages , lands, tenements, hereditments and premises with their and every of their appurtenances.  It was mutually covenanted, granted, concluded and fully agreed by and between all the said parties hereto that they said Daniel Jarvis and Sarah his wife, John Jarvis (party thereto) and Ann his wife, Thomas Wood and Mary his wife, Thomas Holness and Anne his wife, John Reynolds and Ann his wife, John Seath and Elizabeth his wife, William Wildbore and Jane his wife, and John Stanark and Priscilla his wife, should and would acknowledge in due form of Law unto the said Richard Lawrence Bowles and his heirs, one or more fine or fines Sur Conveyance de droit come …. Of all and sign the said several messuages, tenements, lands, hereditments and premises with their appurtenances by the name or names of Two messuages, one Barn, one Stable, five gardens, four acres of land and four acres of pasture with appurtenances, in the Parish of Birchington in the Isle of Thanet, in the County of Kent, or by such other aforesaid and convenient names and descriptions as should be advised.  And it was thereby further covenanted, concluded, declared and fully agreed by and between all the said parties thereto that said Fine when levied should be and ensure (take effect).To the only proper use and behoof of said Richard Lawrence Bowles, his heirs and assigns forever and to and for no other use intent or purpose whatsoever.  Executed by all parties except said Richard Lawrence Bowles and atteste.
